1. Introduction

Welcome to Banclo LTD., a platform provided by Banclo LTD., Northlink Business Centre, Level 2 Burmarrad Road, NAXXAR NXR 6345, Malta ("the Company," "We," "Us," or "Our"). By creating an account, uploading documents, communicating with banks, and selecting mortgage offers, you ("User" or "You") agree to be bound by these Terms of Service. If you do not agree with these terms, please do not use our platform.

2. Account Registration

To access and use certain features of the platform, you must create an account. You are responsible for maintaining the confidentiality of your account credentials and are fully responsible for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

3. Platform Use

Our platform enables users to:

  • Create an account for personalized access to services.
  • Upload multiple documents necessary for mortgage processes.
  • Communicate with participating banks to apply for and discuss mortgage options.
  • Select from available mortgage offers provided by banks.

You agree to use the platform solely for lawful purposes and in compliance with all applicable laws and regulations. Any misuse of the platform may result in account suspension or termination.

4. Document Upload and Content Responsibility

By uploading documents to the platform, you affirm that the information is accurate, lawful, and free of any harmful software or content. You are solely responsible for any documents or data uploaded to the platform and the consequences of their upload. We reserve the right to review, modify, or remove content that violates these Terms or applicable laws.

5. Communication with Banks

The platform facilitates direct communication between users and participating banks for the purpose of discussing and negotiating mortgage options. Banclo LTD. is not responsible for the content of communications between you and any bank, nor for the terms or performance of any mortgage agreements entered into as a result of such communications.

6. Data Retention

Data uploaded or generated in relation to mortgage agreements will be retained for up to 90 days following the completion of a mortgage deed or contract. After this period, data will be deleted from our systems in compliance with our data retention policy unless a longer retention period is required by law.

7. User Conduct and Prohibited Activities

While using the platform, you agree not to:

  • Engage in any unlawful, misleading, or fraudulent activities.
  • Interfere with or disrupt the platform’s functionality.
  • Upload any malicious code, viruses, or any harmful software.
  • Access, collect, or store data about other users without consent.
  • Use the platform in any way that infringes upon the rights of others.

Violation of these terms may result in suspension or termination of your account and legal action if necessary.

8. Intellectual Property

All content and materials available on the platform, including but not limited to software, designs, text, graphics, images, and logos, are the intellectual property of Banclo LTD. or its licensors. Unauthorized use of these materials is prohibited.

9. Limitation of Liability

To the fullest extent permitted by law, Banclo LTD. shall not be liable for any damages, including but not limited to direct, indirect, incidental, or consequential damages, arising from your use of the platform, including any damages related to the accuracy or completeness of mortgage information or offers provided by third-party banks.

10. Termination

We reserve the right to suspend or terminate your account at our discretion if you violate these Terms of Service or engage in activities that are harmful to our platform, other users, or third parties.

11. Changes to Terms of Service

We may update these Terms of Service from time to time. We will notify you of any changes by posting the new Terms on this page and updating the "Last updated" date. You are encouraged to review these Terms periodically. Your continued use of the platform after the changes take effect constitutes acceptance of the revised Terms.
